1    Chelsea Tonubbee will make all reasonable efforts to satisfy the purchaser’s expectations regarding the content and manner of all music performed, including musical selections.

2    If the Purchaser cancels an indoor or outdoor engagement, the Purchaser is subject to pay the following cancellation fees: up to four (4) weeks before the engagement, 25% of the total fee; up to three (3) weeks before the engagement, 50% of the total fee; up to two (2) weeks before the engagement, 75% of the total fee; up to one (1) week before the engagement, 100% of the total fee. The $100 deposit required for booking is non-refundable.

3    In the event the Purchaser reschedules an outdoor engagement due to inclement weather, Chelsea Tonubbee and Ember Strings will perform at the rescheduled time and date for no extra charge so long as it can reasonably provide an available ensemble. In the event an outdoor engagement is rescheduled due to inclement weather and Ember Strings are unable to provide an ensemble, Chelsea Tonubbee will refund the balance of the purchase price, minus the $100 deposit. In no event will the deposit of $100 be refunded. Once Ember Strings begins performing at an outdoor engagement, in no event will purchase monies be refunded. 

4    If Ember Strings are to accompany a vocalist, the vocalist must furnish Ember Strings with the accompaniment in the appropriate ensemble form and in the proper key no less than two weeks prior to the engagement.

5    Ember Strings will play prelude music for a wedding ceremony starting thirty (30) minutes before the scheduled wedding time, unless the Purchaser requests a later start time for prelude music. Ember Strings will not begin playing more than thirty minutes before the wedding start time.

6     Ember Strings, LLC will not begin wedding ceremony music until the start time of the wedding. If a wedding is running a few minutes behind, Ember Strings will continue to play prelude music until the bride, groom and wedding party are ready to begin, then switch to ceremony music.

7     In the event that a wedding ceremony begins more than 15 minutes after the scheduled start time, an additional $50 will be billed for every 15 minute past the start time. 

  
8   The Purchaser should ensure that all necessary steps are taken to provide safe working conditions for the musicians engaged under the terms of this contract. 

9    Ember Strings will not be required to perform under the following conditions: (1) being seated in direct sunlight, (2) temperatures under 55 degrees Fahrenheit, (3) untented during rain/precipitation. 

 

10    PARKING: Parking fees, including Valet, shall be provided in advance, provided that free parking is not available or within reasonable proximity to the performance site. 

 

11    All advertising or programs should list the musicians as “Ember Strings.”

12    Events which take place more than 20 miles outside of St. Petersburg, FL will require a travel cost of $0.625 per mile, per vehicle (minus the first 20 miles, which are included in the standard rates). When possible, only one vehicle will be used, but trios may require two vehicles.

13    This agreement may not be modified or cancelled except by mutual consent in writing by both parties. Any such modification or cancellation shall not prejudice the right to payment of the musicians engaged by Chelsea Tonubbee.
